Welcome to The Realm Fitness (“The Realm,” “we,” “us” or “our”). These Terms of Service (the “Terms”) govern your access to and use of therealmfitness.com and any related pages, features and services we provide (the “Site”), including purchases made through our online merch store (the “Store”).

By accessing or using the Site, or by placing an order through the Store, you agree to these Terms and our Privacy Policy (together, the “Agreement”). If you don’t agree, please don’t use the Site.

Part A — Using the Site

1. About The Realm

The Realm Fitness operates the Site for customers in Canada and the United States.

2. Gym Memberships

These Terms cover the Site and purchases made through the Store. Gym memberships, drop-ins and passes are not sold through the Store. Memberships are purchased through our membership sign-up provider and are governed by the membership agreement you accept when you join. If anything in these Terms conflicts with your membership agreement on a membership matter, your membership agreement applies.

3. Eligibility

You must be the age of majority in your province or territory of residence (or have permission from a parent or legal guardian) to place an order through the Store. By using the Site, you confirm that you meet this requirement.

4. Accounts & Security

You may shop as a guest or create an account. If you create an account, you agree to:

  • Provide accurate, current and complete information
  • Keep your login details confidential
  • Let us know right away about any unauthorized use of your account

You are responsible for all activity that happens under your account.

5. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of applicable laws
  • Interfere with the Site’s security or operation, including hacking, scraping or automated access
  • Copy, reproduce, sell or exploit any part of the Site or its content for commercial purposes without our written permission

We may suspend or restrict access to the Site if we reasonably believe these Terms have been violated.

6. Intellectual Property

All content on the Site, including text, images, graphics, logos, designs, product photography and The Realm name and marks, is owned by The Realm Fitness or its licensors and is protected by Canadian and international intellectual property laws.

You may use the Site and its content for personal, non-commercial purposes only. No content may be copied, modified, distributed or used commercially without our prior written consent.

7. Reviews & User Content

At this time, the Site does not accept customer reviews, comments, uploads or other user-submitted content.

8. Third-Party Links

The Site may link to third-party websites or services, including our membership sign-up provider and social media. The Realm is not responsible for the content, policies or practices of any third-party site.

Part B — Online Store

9. Product Information & Availability

We do our best to show products accurately, but colours, fit and appearance may vary by screen or device.

Product availability is not guaranteed. If an item becomes unavailable after you place an order, we may cancel that item or the whole order and refund the unavailable portion.

10. Pricing

Prices are shown in Canadian Dollars (CAD) for Canadian customers and US Dollars (USD) for customers in the United States. You can switch your country and currency at the top of the Site, and the currency you see at checkout is the currency you will be charged in. Prices may change without notice.

If a pricing error occurs, we may cancel the order and issue a refund.

11. Taxes, Duties & Import Charges

Applicable taxes are calculated based on the shipping or pickup address and shown at checkout.

For orders shipped to the United States, duties and import taxes are calculated and collected at checkout and shown as a separate charge. See our Shipping Policy for details.

12. Payment

We accept the payment methods shown at checkout. By submitting payment information, you confirm that you are authorized to use that payment method.

We may cancel any order if payment authorization fails or is reversed.

13. Order Confirmation & Acceptance

After you place an order, you’ll receive an order confirmation email acknowledging that we received it. This does not mean your order has been accepted.

Your order is accepted when it ships and a shipping confirmation is sent, or when we notify you that it’s ready for pickup.

14. Shipping, Delivery & Pickup

We ship within Canada and to the United States. Local pickup is also available at The Realm, 1390 17 Ave SE, Calgary.

Additional fees, longer delivery times or carrier limitations may apply to remote or rural areas. Any applicable charges are shown at checkout where possible.

15. Returns, Exchanges & Refunds

Returns and exchanges are governed by our Refund Policy, which forms part of these Terms. If there is any conflict, the Refund Policy applies.

Part C — Legal

16. Disclaimer

The Site and all content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

17. Limitation of Liability

To the fullest extent permitted by applicable law, The Realm Fitness is not liable for any indirect, incidental, consequential or special damages arising from your use of the Site or products purchased through the Store.

Nothing in these Terms limits any rights you may have under applicable Canadian consumer protection laws.

18. Indemnification

You agree to indemnify and hold harmless The Realm Fitness from any claims arising from your misuse of the Site or violation of these Terms, to the extent permitted by law.

19. Governing Law

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

If you are a resident of Quebec, nothing in these Terms limits your rights under the Consumer Protection Act (Quebec), and Quebec law applies where required.

20. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Site after an update means you accept the revised Terms.
